Website Terms

Terms of Use

These Terms of Use govern access to and use of avitican.com and the information, forms, features, and materials available through this website.

Effective date: July 19, 2026

Please read these Terms of Use before using avitican.com.

By accessing, browsing, submitting information through, or otherwise using this website, you acknowledge and agree to these Terms of Use and the AVITICAN Privacy Policy.

If you do not agree, do not use the website.

Section 01

Agreement to Terms

These Terms of Use are an agreement between you and LOXENKEY LLC, operating under the AVITICAN brand, concerning access to and use of this website.

Additional terms may apply to services, proposals, assignments, portals, documents, communications, or other business relationships. If these website terms conflict with a written agreement executed by LOXENKEY LLC, the executed agreement controls with respect to its subject matter.

Section 02

Website Operator

AVITICAN is a brand operated by LOXENKEY LLC. In these Terms, “AVITICAN,” “we,” “our,” and “us” refer to LOXENKEY LLC operating under the AVITICAN brand, as the context requires.

“You” and “your” refer to the individual using the website and any organization that the individual is authorized to represent.

Section 03

Website Purpose

This website provides general information about AVITICAN, its areas of focus, potential services, operating approach, contact methods, and related protective subjects.

Website content is provided for general informational and business-development purposes. It is not legal advice, emergency instruction, individualized protective advice, a threat assessment, or a recommendation for a particular person or situation.

Protective requirements depend on circumstances that cannot be evaluated through general website content, including the individual, organization, environment, timing, location, available information, applicable requirements, and operational conditions.

Section 04

No Client, Protective, or Service Relationship

Accessing the website, submitting a form, sending an email, calling a telephone number, or requesting information does not create a client, contractual, fiduciary, protective, agency, or other professional relationship.

AVITICAN is not obligated to accept, evaluate, respond to, or undertake an inquiry, request, assignment, or proposed engagement. A service relationship exists only after all required evaluations, approvals, agreements, payment arrangements, and other engagement requirements have been completed and confirmed in writing.

No service is confirmed through the website alone.

Do not assume that personnel, protective transportation, monitoring, planning, coordination, or other support has been scheduled until the engagement is expressly confirmed in writing.

No emergency or immediate-response service

AVITICAN is not a public emergency service, law-enforcement agency, emergency communications center, or substitute for police, fire, medical, or other emergency responders. Website forms, email, and general business telephone lines are not continuously monitored for emergencies.

For an immediate threat to life, safety, or property, contact 911 or the appropriate local authorities.

Section 05

Eligibility and Authority

You must be at least 18 years old to submit a service inquiry or use the website for business purposes.

If you use the website for a company, organization, family office, household, agency, or other entity, you represent that you are authorized to act on its behalf. Information you provide must be accurate, current, lawful, and not misleading.

Section 06

Acceptable Use

You may use the website only for lawful purposes. You may not:

  • Violate applicable law, legal rights, court orders, or contractual duties.
  • Submit fraudulent, deceptive, defamatory, threatening, abusive, or unlawful material.
  • Impersonate another person or misrepresent identity, authority, affiliation, or intent.
  • Seek services for an unlawful, deceptive, unauthorized, or improper purpose.
  • Transmit malicious code, harmful files, automated scripts, or disruptive technology.
  • Probe, scan, bypass, interfere with, or compromise website security or access controls.
  • Scrape, harvest, monitor, or extract website content or data through unauthorized automated means.
  • Use AVITICAN’s identity or systems for spam, fraud, or unauthorized commercial activity.

Access may be restricted or blocked when misuse, suspicious activity, a security risk, or a violation of these Terms is reasonably suspected.

Section 07

Intellectual Property

Unless otherwise stated, the website and its content—including names, marks, logos, designs, text, graphics, layouts, photographs, documents, and service descriptions—are owned by or licensed to LOXENKEY LLC and are protected by applicable intellectual-property laws.

You may view and print limited website material for lawful, noncommercial evaluation of AVITICAN and its potential services. Without prior written permission, you may not:

  • Reproduce, republish, distribute, sell, sublicense, or exploit substantial website content.
  • Modify content or create misleading or unauthorized derivative materials.
  • Remove ownership, trademark, or copyright notices.
  • Use AVITICAN branding to imply endorsement, authorization, or affiliation.
  • Register confusingly similar names, domains, or accounts.

No right, title, license, or interest is granted except for the limited permission expressly stated in these Terms.

Section 08

Website Submissions and Communications

You are responsible for information, messages, documents, and other material you submit. You represent that you have the right to provide it and that submission does not violate another person’s rights, privacy, confidentiality, contract, or applicable law.

You authorize AVITICAN and its service providers to receive, store, review, transmit, and otherwise process submitted information as reasonably necessary to respond to an inquiry, evaluate a potential relationship, operate and secure the website, maintain records, and conduct legitimate business activities, subject to the Privacy Policy.

Sensitive information

Website forms, ordinary email, and general telephone communications may not be appropriate for highly sensitive, privileged, regulated, or operationally critical information.

Do not submit detailed itineraries, access credentials, alarm codes, security procedures, medical records, government identification numbers, payment-card information, classified material, or similar sensitive content through a general website form or initial email.

Receipt of unsolicited information does not create a duty of confidentiality, professional privilege, or client relationship beyond obligations imposed by applicable law or an executed written agreement.

Section 09

Third-Party Websites and Services

The website may link to or use platforms, forms, hosting providers, analytics, maps, email services, or other resources operated by third parties.

AVITICAN does not control third-party services and is not responsible for their availability, security, accuracy, content, terms, privacy practices, or conduct. Use of a third-party service is subject to that provider’s terms and policies.

Section 10

Website Disclaimers

The website and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, AVITICAN disclaims express, implied, and statutory warranties regarding the website and its content, including warranties of accuracy, completeness, availability, reliability, merchantability, fitness for a particular purpose, title, security, and noninfringement.

AVITICAN does not warrant that:

  • The website will always be available, secure, or error-free.
  • Content will be complete, current, or suitable for every purpose.
  • Messages or form submissions will be received or answered.
  • A requested service will be available, accepted, or appropriate.
  • Use of website information will prevent harm, loss, disruption, or risk.

References to services, capabilities, locations, or professional areas do not guarantee availability, acceptance, licensing authority, staffing, vehicles, insurance coverage, timing, or suitability for a particular assignment.

Section 11

Limitation of Liability

To the fullest extent permitted by applicable law, LOXENKEY LLC, AVITICAN, and their owners, managers, personnel, contractors, representatives, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to:

  • Access to or inability to access the website.
  • Use of or reliance on website content.
  • Website interruption, error, delay, or security incident.
  • Loss of data, opportunity, revenue, reputation, or business.
  • Third-party websites, services, content, or conduct.
  • Messages, forms, or communications that are delayed, altered, or not received.
  • Unauthorized access to or alteration of submitted information.

To the fullest extent permitted by law, total aggregate liability arising solely from use of this website will not exceed the greater of one hundred United States dollars or the amount, if any, paid specifically for access to the website during the twelve months before the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. Where a limitation is prohibited, liability is limited only to the maximum extent permitted by law.

Section 12

Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless LOXENKEY LLC, AVITICAN, and their owners, managers, personnel, contractors, representatives, and service providers from third-party claims, losses, liabilities, damages, judgments, costs, and reasonable expenses arising from:

  • Your unlawful or unauthorized use of the website.
  • Your material violation of these Terms.
  • Your violation of another person’s rights.
  • Information or material you submit.
  • Your fraud, intentional misconduct, or material misrepresentation.

This provision does not require indemnification to the extent it is prohibited by applicable law.

Section 13

Governing Law and General Provisions

These Terms and disputes arising from the website are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles, except where applicable law requires otherwise.

To the extent permitted by law, a legal proceeding relating to these Terms or the website must be brought in an appropriate state court in Anderson County, Tennessee, or an appropriate federal court in the Eastern District of Tennessee. You consent to the jurisdiction and venue of those courts for such proceedings.

Severability

If a provision is held unlawful, invalid, or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.

No waiver

Failure to enforce a provision does not waive the right to enforce it or another provision later.

Entire agreement

These Terms and the Privacy Policy constitute the entire agreement concerning general website use, except where a separate written agreement applies.

Section 14

Changes to the Website and These Terms

AVITICAN may modify, suspend, restrict, or discontinue website content or functionality. These Terms may be revised when the website, technology, business practices, or applicable requirements change.

Revised Terms will be posted on this page with an updated effective date. Continued use after revised Terms are posted constitutes acceptance to the extent permitted by applicable law.
